Welcome to Turf. These Terms of Service ("Terms") are the rules for using Turf. Questions, feedback or support requests are welcome at team@turfyeah.com.

1. Introduction

1.1 Who we are and what these Terms cover

These Terms are an agreement between you and the operator of Turf, Marcelo Ranieri, an individual who operates the service known as Turf, including beta.turfyeah.com and any related websites and apps (together, "Turf" or the "Service"). In these Terms, "Turf", "we", "us" and "our" mean the operator of Turf, and "you" means the person using Turf. A Delaware corporation, Supersonic Fields, Inc., is being formed to operate Turf. When it is formed, these Terms will be assigned to it under section 7.4 and we will tell you. Our mailing address is Turf, 6801 Collins Ave, Miami Beach, FL 33141, United States. By creating an account or using Turf, you agree to these Terms, our Privacy Policy, our Community Guidelines and our Fair Use and Intellectual Property Policy. If you do not agree, do not use Turf.

1.2 About Turf

Turf is a social app built around daily debates: group chatrooms, each about one topic, that are open for a limited time shown in the app and then end. In some parts of the Service and in older versions of these Terms, debates are called "Circles". Messages in a debate are deleted within 48 hours after the debate ends. Direct messages between users are kept until deleted. Turf is designed for in-the-moment conversation without a permanent public record.

1.3 Who can use Turf

You must be at least 18 years old. By using Turf you confirm that you are 18 or older, that you can enter into a binding agreement, that you will follow these Terms and the law, and that you have not been banned from Turf before. Turf is offered for use in the United States. Section 7.2 explains what applies if you use Turf from another country.

1.4 Beta

Turf is in beta. Features may change, stop working or be removed, and the Service may sometimes be unavailable or lose data. We provide the beta as is, for free, and we may change or end it at any time. We will give you notice before any change that would delete your account or your direct messages, except where we must act quickly for safety or legal reasons. Please do not rely on Turf as the only place you keep anything important.

2. Accounts

2.1 Creating an account

To use Turf you need an account. You can sign up with a username, an email address and a password, a sign-in link sent to your email, or Google. Your username, display name, photo and bio are public. Your email address is private and is used to sign you in and to send you account and notification emails. Give accurate information and keep it current. One person, one account.

2.2 Account security

You are responsible for everything that happens in your account. Use a strong, unique password, keep it to yourself, log out of shared devices, and email team@turfyeah.com right away if you think someone else has used your account. We are not liable for loss caused by someone using your account because it was not protected.

2.3 Ending your account

You can delete your account at any time in Settings. We may suspend or end your account if you break these Terms or the law, if we need to do so to comply with a legal obligation, or if your use creates a risk for other users or for Turf. When it is safe and lawful, we will tell you why.

When your account is deleted:

  • Your profile, upvotes, blocks and settings are removed.
  • Your debate messages are deleted on the normal schedule, within 48 hours after the debate ends.
  • Direct messages you sent stay visible to the people you sent them to, shown as from "Deleted account", until those people delete the conversation. Messages other people sent you are removed from your account.
  • We keep a limited set of identifiers linked to reports, blocks and enforcement actions, such as your account ID, a hashed form of your email address and recent IP addresses, for up to 180 days. We do this to handle open reports and to stop banned users from coming back. We may keep information longer where section 3.6 or the law requires it.

2.4 What you may not do

  • Create multiple accounts to get around a ban or to manipulate Turf
  • Share your account or let someone else use it
  • Impersonate another person or organization
  • Use bots, scrapers or other automated tools on Turf without our written permission
  • Try to access other accounts, our systems or data you are not allowed to access
  • Interfere with or disrupt the Service, or try to get around its limits and protections

3. Content

3.1 Your content

"User Content" means anything you post or send on Turf, including debate messages, direct messages, profile information, images and reports. You own your User Content, and you are responsible for it. You promise that you have the rights needed to share it and that it does not break these Terms, our Community Guidelines or the law.

Direct messages are private between the people in the conversation, but they are not end-to-end encrypted. Our systems store them, and authorized Turf personnel may access them when needed to investigate a report, keep people safe, operate or fix the Service, or comply with the law.

3.2 What other users can do

Debate messages are visible to other people on Turf while the debate is open, and others may copy or screenshot anything while it is visible. Do not post anything you would not want someone else to save or share.

3.3 The license you give us

You give Turf a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display and adapt (for example, resize or format) your User Content, only as needed to: (a) operate, provide and improve Turf; (b) moderate content, enforce these Terms and keep users safe; (c) comply with the law; and (d) create aggregated or de-identified statistics that do not identify you.

This license ends when your User Content is deleted from Turf, except for copies we keep under section 3.6 and direct messages other users have already received. We will not use your User Content, name or image in advertising or promotional material, on Turf or anywhere else, unless you give us separate permission for that specific use. You can withdraw that permission at any time for future uses.

3.4 Content we do not allow

You may not post User Content that:

  • Breaks the law
  • Promotes violence, self-harm or dangerous activities
  • Attacks or harasses people based on race, ethnicity, national origin, religion, gender, sexual orientation, disability or other protected characteristics
  • Contains pornography, sexual exploitation or intimate images shared without consent
  • Sexualizes, exploits or endangers minors
  • Is spam, a scam, phishing or otherwise deceptive
  • Infringes copyrights, trademarks or other intellectual property rights
  • Shares someone's private information without their consent
  • Spreads false information that could cause real harm

3.5 Moderation and child safety

We may review, remove, restrict or label content, and suspend or end accounts, when we believe they break these Terms or the law. We review content mainly when someone reports it. We do not review every message, and we are not required to monitor Turf.

Images uploaded to Turf, including images in debates and direct messages, profile photos and debate header images, are delivered through our content delivery network, which automatically checks them against lists of known child sexual abuse material (CSAM) maintained by child safety organizations. All images uploaded to Turf are also checked for adult, sexually suggestive and violent content before they are published, except profile photos and debate header images uploaded by Turf staff. We automatically check the text of debate and direct messages with a keyword list and OpenAI's moderation tool, and we send some flagged debate messages to Anthropic to check whether they are a genuine threat.

We do not tolerate child sexual exploitation. When we become aware of apparent CSAM or the sexual exploitation of a child, we remove it, preserve it as the law requires, report it to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A, and permanently ban the account. If you see content that exploits a child, report it in the app or email team@turfyeah.com. You can also report it directly to NCMEC at CyberTipline.org.

3.6 How long we keep content

  • Debate messages: deleted within 48 hours after the debate ends.
  • Direct messages: kept until you delete the conversation or delete your account. Deleting a conversation removes it from your account only. The other person keeps their copy until they delete it too, and messages you sent stay visible to them as from "Deleted account" if you delete your account.
  • Reported content: if content is reported, we keep a copy in a restricted archive that no user can see, for up to 365 days after we close the report, and longer only under a legal hold or a request from NCMEC or law enforcement.
  • Child safety: content we report to NCMEC is kept for one year after the report, as federal law requires, and longer only if needed to protect children or if law enforcement asks us to.
  • Legal holds: we may keep specific content longer if we receive a valid legal request or need it for a legal claim, and only for as long as that need lasts.
  • Backups: deleted within 48 hours.

3.7 Aggregated statistics

We may create and use statistics about how Turf is used (for example, how many people joined a debate) that do not identify you.

3.8 Copyright

We respect intellectual property and expect you to do the same. If you believe content on Turf infringes your copyright, send a notice to our designated agent:

Our designated agent is registered with the U.S. Copyright Office DMCA Designated Agent Directory (dmca.copyright.gov). Our Fair Use and Intellectual Property Policy explains what a notice must contain under 17 U.S.C. § 512(c)(3), how counter-notices work, and our repeat infringer policy: an account that receives three valid takedown notices within 12 months may be terminated.

3.9 Enforcement notices and appeals

Where reasonable and lawful, we will tell you when we remove your content or suspend your account, including the general reason and how to appeal. To appeal, email team@turfyeah.com within 30 days. Where practical, someone other than the person who made the original decision reviews the appeal. We may share a summary of the content and the rule involved, but not internal signals or legally restricted information. We will tell you the outcome through the Service or the email address on your account.

4. Privacy

Our Privacy Policy explains what information we collect, how we use and share it, and how long we keep it. You can correct your profile and delete your account in Settings; for a copy of your information, or any other request, email team@turfyeah.com from your account's email address. We answer within 30 days. By using Turf you agree to the Privacy Policy.

5. Disclaimers, liability and Turf accounts

5.1 The Service is provided as is

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT CONTENT ON THE SERVICE, INCLUDING CONTENT FROM TURF ACCOUNTS, IS ACCURATE OR RELIABLE.

5.2 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURF WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE. IN NO EVENT WILL TURF'S TOTAL LIABILITY EXCEED THE GREATER OF (A) 100 US DOLLARS OR (B) THE AMOUNT YOU PAID TURF IN THE 12 MONTHS BEFORE THE CLAIM. Some states do not allow some of these limitations; in those states they apply only as far as the law allows.

5.3 Indemnification

You agree to indemnify, defend and hold harmless the operator of Turf and, once formed, Supersonic Fields, Inc., and their officers, directors, employees and agents, from claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, your breach of these Terms, or your violation of anyone's rights or the law.

5.4 Third-party content and links

The Service may contain links to third-party websites or services. We are not responsible for their content, accuracy, privacy practices or terms, or for any harm they cause.

5.5 Turf accounts

During the beta, Turf runs some of its own accounts that post in debates to start conversations and keep them going. These Turf accounts are managed by the Turf team, and their lines are written by Turf; they are not members of the community. Like any account, they may post, reply, react, upvote, downvote and report, on content from other Turf accounts and from people who sign up for Turf. They follow these Terms and the Community Guidelines like everyone else, and a Turf account reports content only when the Turf team believes it breaks them. Their votes and reactions are counted like anyone's, and their reports go through the same review as any report. Turf accounts always show the Turf tag, do not send or receive direct messages, and do not appear in suggestions. They are counted like any other account in member, participant and follower numbers. Positions a Turf account takes are assigned for the debate and are not anyone's personal opinion.

6. Changes to these Terms

We may change these Terms to reflect changes in Turf, the law or our business. For material changes that reduce your rights or expand what we may do with your content or information, we will give you at least 30 days' notice by email to the address on your account and by a notice in the app, and we will post the new version with its effective date. Other changes take effect when posted. If you keep using Turf after a change takes effect, you accept it. If you do not agree, delete your account in Settings before the effective date. Previous versions are listed at the end of these Terms.

7. General

7.1 Governing law

These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict of laws rules. If you live in a US state whose consumer protection laws give you rights that cannot be waived by contract, nothing in these Terms takes those rights away.

7.2 Resolving disputes

  • Talk to us first. Before filing a claim, you agree to email team@turfyeah.com with a short description of the problem and what you want, and to give us 30 days to try to resolve it. We will do the same before filing a claim against you.
  • Where claims are heard. Any claim between you and Turf will be brought only in the state or federal courts located in Miami-Dade County, Florida, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small claims court in the US county where you live, if the claim qualifies.
  • No arbitration. Disputes under these Terms are not subject to arbitration.
  • No class actions. To the extent permitted by law, you and Turf each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative action.
  • Jury waiver. To the extent permitted by law, you and Turf each waive the right to a jury trial.
  • If part of this section is unenforceable. If the class action waiver or jury waiver is found unenforceable for a particular claim, that part will not apply to that claim, and the rest of this section still applies.
  • Users outside the United States. Turf is offered for use in the United States. If you use Turf from another country, you do so on your own initiative, and these Terms still apply, except where the mandatory consumer laws of your country give you rights that cannot be waived.

7.3 Severability

If any part of these Terms is found invalid or unenforceable, the rest stays in effect.

7.4 Entire agreement, waiver and assignment

These Terms, with the Privacy Policy, Community Guidelines and Fair Use and Intellectual Property Policy, are the entire agreement between you and Turf about the Service. If we do not enforce a provision, that is not a waiver of it. You may not transfer your account or these Terms to anyone else. We may assign these Terms to Supersonic Fields, Inc. once it is formed, or to a company that acquires Turf, and we will tell you when that happens.
